The Constitution of Ukraine establishes that Ukraine is a sovereign and independent, democratic, social, legal state ( Article 1 ); a person, his life and health, honor and dignity, inviolability and security are recognized in Ukraine as the highest social value; human rights and freedoms and their guarantees determine the content and direction of the state's activities; the state is responsible to man for its activities; the establishment and provision of human rights and freedoms is the main duty of the state ( Article 3) .
The principle of the rule of law is recognized and operates in Ukraine; the Constitution of Ukraine has the highest legal force; laws and other regulatory legal acts are adopted on the basis of the Constitution of Ukraine and must comply with special database it ( parts one and two of Article 8 of the Fundamental Law of Ukraine).
Set out in the Decision of October 19, 2009 No. 26-rp/2009 , the constitutional rights and freedoms of man and citizen cannot be restricted, except in cases provided for by the Constitution of Ukraine ( Part One of Article 64 of the Fundamental Law of Ukraine); the establishment of restrictions on the rights and freedoms of man and citizen is permissible only on condition that such a restriction is reasonable (proportional) and socially necessary ( paragraph six of subparagraph 3.3 of paragraph 3 of the motivational part).
According to Part One of Article 29 of the Constitution of Ukraine, every person has the right to freedom and personal integrity. The right to freedom is an inalienable and inalienable constitutional right of a person and provides for the ability to choose one's behavior for the purpose of free and comprehensive development, to act independently in accordance with one's own decisions and plans, to determine priorities, to do everything that is not prohibited by law, to move freely and at one's own discretion throughout the territory of the state, to choose one's place of residence, etc.; this right means that a person is free in his or her activities from external interference, with the exception of restrictions established by the Constitution and laws of Ukraine ( paragraph two of subparagraph 2.3 of paragraph 2 of the motivational part of the Decision of the Constitutional Court of Ukraine dated June 1, 2016 No. 2-rp/2016).
